Buying Real Estate In The process of buying Real-estate in The only restrictions that apply are; 1.You cannot buy real-estate within certain military areas 2.Special permission is required to buy large areas of land. When you have choosen your property you will be asked to sign a contract with us at Bayindir. This contract states; Your Name The Sellers Name Property Details Total Price payable Amount of deposit paid Amount Payable on completion Commission payable Compensation payable in case of default by either party We will obtain a Tax Number for you. You will need: Your Passport Details of your parents names Four passport size photographs We will help you open a Bank Account You will need: Your Passport Your Tax Number Bayindir will then visit the Deed Office on your behalf to initiate the legal buying process. The Deed Office will then make all the legal searches on the property and make sure that the owner is legitimate and has the right to sell the property. Checks will also be made to ensure the property does not fall within a restricted military area. We will need: Copy of your Passport Your Tax Number On completion of these checks (Usually 6-8 weeks) a permit is issued giving you permission to complete the sale. When this permit is received we will notify you and arrange a time to accompany you and the seller to the Deed Office to complete the purchase. At this time an official translator will be present to explain all documentation and the procedure to you. At this stage you will need: Your Passport On completion of the documentation you will be issued with the TAPU or title deeds to the property and of course the keys!! NB
If it is inconvenient or not possible for you to return to Kusadasi for the completion formalities, you can leave a ‘Power of Attorney’ with either Bayindir or a solicitor to act on your behalf. This is a legal document drawn up by a Public Notary, in the presence of an official translator. It allows the named person to act on your behalf only in this matter and not in any other capacity. (The cost for a solicitor is appro 500-1000 Euros). New Procedure The Turkish system is very straightforward and is currently only delayed by the time taken to check the restricted area status of the property. Because Turkish citizens have no restrictions as to where they can buy property they are able to buy a property within hours!! A new system is being introduced that will ‘zone’ all properties so that it will be apparent if a property is in a restricted area without the need for application to the relevent government department. This system will hopefully be introduced shortly and will mean that non Turkish nationals will also be able to complete purchases in a matter of hours. Payments Because Turkish citizens complete the buying process in a matter of hours, with the payment and the Tapu being transferred simultainously the seller requires payment at ‘The agreement to buy’ stage. The checks to ensure the purchase does not fall within a restricted area are a formality. Properties within restricted areas are not offered for sale to non Turkish citizens. ANNEX 1 1. ANDORRA
